Juridical Subterfuges (Hiyal) in the Current Islamic Banking and Financial Field

Abstract

The article concerns the role and implication of juridical subterfuges in the structered finance, that are used in the current Islamic banking and financial field. The author reviews the first historical sources of the early XXth century, relating to the issues of Islamic economics. Moreover, he analyzes the application of juridical subterfuges with the purpose to avoid the proscription of the borrowing rate riba, used in the current Islamic banking and financial field. Furthermor, the paper emphasizes new conditions of the Islamic law, which doesn’t regulate any more the financial operations in the Islamic banking and financial field, niether is legally binding, but is regardered as ethical principles without legal substance.
